"THAT in consideration of Staff Report OP-24-009 respecting Street Occupation By-law Review, the Operations Committee recommends that City Council approves the recommendations in the report and directs staff to: 1. Bring forward by-laws to: a. amend the Fees and Charges By-law as proposed in the Schedule of Recommended Temporary Encroachment Permit Fees, Security Deposits and Daily Fee, attached to this report; b. adopt the Temporary Encroachment By-law, draft by-law attached to this report and repeal By-law No. 2010-169; c. amend the Delegation of Authority By-law to include the delegation of powers outlined in the Temporary Encroachment By-law to: i. the Director of Public Works and Engineering to administer the permit process; and ii. the City Manager to act as the appeal body for permit refusals; and 2. Submit a set fine application to the Ministry of the Attorney General as proposed in the Schedule of Recommended Set Fines for Violations under the Temporary Encroachment By- law, attached to this report."
